A record of the words and teachings of Confucius, _The Analects_ is considered the most reliable expression of Confucian thought. However, the original meaning of Confucius's teachings have been filtered and interpreted by the commentaries of Confucianists of later ages, particularly the Neo-Confucianists of the Song dynasty, not altogether without distortion.In this monumental translation by Professor D. C. Lau, an attempt has been made to interpret the sayings as they stand. The corpus of the sayings is taken as an organic (...) whole and the final test of the interpretation rests on the internal consistency it exhibits. In other words, _The Analects_ is read in the light of _The Analects._This results in a truer understanding of Confucius' thought than the traditional interpretation and paves the way for a re-assessment of its importance in the history of Chinese thought and its relevance to the present day world.This volume also contains an introduction to the life and teachings of Confucius, and three appendices on the events in the life of Confucius, on his disciples, and on the composition of _The Analects._. This volume contains C. D. Broad's Cambridge lectures on Ethics. Broad gave a course of lectures on the subject, intended primarily for Part I of the Moral Sciences Tripos, every academic year from 1933 - 34 up to and in cluding 1952 - 53 (except that he did not lecture on Ethics in 1935 - 36). The course however was frequently revised, and the present version is es sentially that which he gave in 1952 - 53. Broad always wrote out (...) his lectures fully beforehand, and the manuscript on Ethics, although full of revisions, is in a reasonably good state. But his handwriting is small and close and in places difficult to decipher. I therefore fear that some words may have been misread. There was an additional complication. In the summer of 1953 Broad revised and enlarged two sections of the course, namely the section on "Moore's theory" and that on "Naturalistic theories" (both sections occur in Chapter 4). The revised version of the section on Moore is undoubtedly superior to the earlier version, and I have therefore included it. But in my opinion this is not true of the new version of the section on naturalistic theories: although more comprehensive than the earlier version, it is not only repetitive in itself, but also repeats, sometimes almost verbatim, passages which occur elsewhere in the lectures. In brief, the new version is not fully integrated with the rest of the course. (shrink)

This paper argues that the concept and role of ‘institutional racism’ in contemporary discussions of race should be reconsidered. It starts by distinguishing between ‘intrinsic institutional racism’, which holds that institutions are racist in virtue of their constitutive features, and ‘extrinsic institutional racism’, which holds that institutions are racist in virtue of their negative effects. It accepts intrinsic institutional racism, but argues that a ‘disparate impact’ conception of extrinsic conception faces a number of objections, the most serious being that it (...) has no plausible account of what it is that makes extrinsically racist institutions racist. It also argues that claims about the explanatory indispensability of institutional racism are overstated (individual racism is at least as important), critiques structural approaches to racial inequality, and suggests that there is reason to doubt whether institutional reform can provide us with all that morality may require in the racial domain. Several philosophers have developed accounts to dissolve the apparent conflict between deterministic laws of nature and objective chances. These philosophers advocate the compatibility of determinism and chance. I argue that determinism and chance are incompatible and criticize the various notions of “deterministic chance” supplied by the compatibilists. Many of the compatibilists are strongly motivated by scientific theories where objective probabilities are combined with deterministic laws, the most salient of which is classical statistical mechanics. I show that, properly interpreted, statistical mechanics (...) is either an indeterministic theory or else its probabilities are not chances, just as incompatibilism demands. (shrink)

Putnam, 'The Meaning of Meaning' This book explores some truths behind the truism that experimentation is a hallmark of scientific activity. Scientists' descriptions of nature result from two sorts of encounter: they interact with each other and with nature. Philosophy of science has, by and large, (...) failed to give an account of either sort of interaction. Philosophers typically imagine that scientists observe, theorize and experiment in order to produce general knowledge of natural laws, knowledge which can be applied to generate new theories and technologies. This view bifurcates the scientist's world into an empirical world of pre-articulate experience and know how and another world of talk, thought and argument. Most received philosophies of science focus so exclusively on the literary world of representations that they cannot begin to address the philosophical problems arising from the interaction of these worlds: empirical access as a source of knowledge, meaning and reference, and of course, realism. This has placed the epistemological burden entirely on the predictive role of experiment because, it is argued, testing predictions is all that could show that scientists' theorizing is constrained by nature. Here a purely literary approach contributes to its own demise. The epistemological significance of experiment turns out to be a theoretical matter: cruciality depends on argument, not experiment. This article explores the meeting of two approaches towards philosophy and education: the philosophy for children approach advocated by Lipman and others, and Schmid’s philosophical concept of Lebenskunst. Schmid explores the concept of the beautiful or good life by asking what is necessary for each individual to be able to develop their own art of living and which aspects of life are significant when shaping a good and beautiful life. One element of Schmid’s theory is the practical application of philosophy (...) through the notions of Bildung, reflection, prudence and practical wisdom, as well as the requirement for each individual to take responsibility for actively shaping their life as an artwork. In this sense, each person is the artist responsible for living their own beautiful life. We argue that there are useful parallels between Schmid’s concept of the art of living and P4C, such as the ideal of a holistic philosophy that is “lived.” The pragmatic approach of P4C focuses on the embodied learner who practices critical, caring and creative thinking. Both P4C and Schmid’s theory are reminiscent of the Aristotelian notion of practical wisdom, which allows for an approach to an education for life that prepares students to develop their own art of living. This article discusses the adequacy of Rawls’ theory of justice as a tool for racial justice. It is argued that critics like Charles W Mills fail to appreciate both the insights and limits of the Rawlsian framework. The article has two main parts spread out over several different sections. The first is concerned with whether the Rawlsian framework suffices to prevent racial injustice. It is argued that there are reasons to doubt whether it does. The second part is concerned with (...) whether a Rawlsian framework has the resources to rectify past racial injustice. It is argued that it has more resources to do this than Mills allows. This second part of the article centers on two Rawlsian ideas: ideal theory and the fair equality of opportunity principle. It is argued that ideal theory is essential for the kind of rectificatory work that Mills wants nonideal theory to do, and that where there is a socioeconomic legacy of past injustice, it is hard to see how FEO could be implemented if it did no rectificatory work, a result which means that there is less need to turn to nonideal theory at all. This chapter presents and illustrates fundamental principles of the intuitionistic mathematics devised by L.E.J. Brouwer and then describes in largely nontechnical terms metamathematical results that shed light on the logical character of that mathematics. The fundamental principles, such as Uniformity and Brouwer’s Theorem, are drawn from the intuitionistic studies of logic and topology. The metamathematical results include Gödel’s negative and modal translations and Kleene’s realizability interpretation. The chapter closes with an assessment of anti-realism as a philosophy of intuitionism.

Introduction: Variation across research ethics boards in conditions placed on access to medical records for research purposes raises concerns around negative impacts on research quality and on human subject protection, including privacy.Aim: To study variation in REB consent requirements for retrospective chart review and who may have access to the medical record for data abstraction.Methods: Thirty 90-min face-to-face interviews were conducted with REB chairs and administrators affiliated with faculties of medicine in Canadian universities, using structured questions around a case study (...) with open-ended responses. Interviews were recorded, transcribed and coded manually.Results: Fourteen sites required individual patient consent for the study to proceed as proposed. Three indicated that their response would depend on how potentially identifying variables would be managed. Eleven sites did not require consent. Two suggested a notification and opt-out process. Most stated that consent would be required if identifiable information was being abstracted from the record. Among those not requiring consent, there was substantial variation in recognising that the abstracted information could potentially indirectly re-identify individuals. Concern over access to medical records by an outside individual was also associated with requirement for consent. Eighteen sites required full committee review. Sixteen allowed an external research assistant to abstract information from the health record.Conclusions: Large variation was found across sites in the requirement for consent for research involving access to medical records. REBs need training in best practices for protecting privacy and confidentiality in health research. A forum for REB chairs to confidentially share concerns and decisions about specific studies could also reduce variation in decisions. (shrink)

Recently Mr. E. Courtney has reopened discussion on the authenticity of the last six Heroides, a subject which had almost universally been accepted as settled by scholars.2 He also briefly discussed the ninth epistle and examined certain grounds for doubting whether it is rightly included in the Ovidian canon. In this he is following Karl Lachmann, who was disposed to doubt the authenticity not only of the last six but also of those of the remainder which are not mentioned in (...) Ovid's catalogue of the epistles given at Amores 2. 18 f.3 This despoliation of the canon has not generally found favour since Lachmann, and in the case of Heroides 9 the editors and other scholars working on the poems 4 have without exception regarded the poem as a genuine specimen of Ovid's work. In deriving his moral code, Hobbes does not appeal to any mind-independent good, natural human telos, or innate human sympathies. Instead he assumes a subjectivist theory of value and an egoistic theory of human motivation. Some critics, however, doubt that his laws of nature can be constructed from such scant material. Hobbes ultimately justifies the acceptance of moral laws by the fact that they promote self-preservation. But, as Hobbes himself acknowledges, not everyone prefers survival over natural liberty. In this essay (...) I show that Hobbes can argue that the desire for self-preservation is rationally required by modifying his subjectivist theory of the good to equate what is good for an agent only with the satisfaction of desires (for her own life) that she has at the time that they are satisfied. It is thus irrational to prefer postmortem glory over survival since an agent must be alive for glory to have any value for her. (shrink)

If there is a “basic structure objection” to G.A. Cohen’s incentive critique of Rawls, then there is also a BSO to claims that private racial discrimination thwarts social justice by reducing the opportunity of its targets. In this paper, I take up the debate about the site or purview of justice and discuss it with reference to the case of race. I argue that the dispute about the site of justice has been wrongly understood as a dispute about the substantive (...) requirements of justice instead of as a dispute about where it is appropriate to apply considerations of justice. The current concern with reforming and regulating managed care under the general rubric of “patients' rights” has eclipsed the more fundamental need to legislate the human rights of those without adequate access to any healthcare. To characterize the regulatory activity as a “rights” movement inflates its moral dimension. The concept of “rights” carries a serious and powerful moral force that is currently inappropriately applied to the parochial concerns of a segment of the population privileged to have health insurance coverage. By (...) contrast, the language of “rights” refers to a high level of universality for the most rudimentary of human concerns. If there was a universal right to become a patient equal to other patients, a concept of patients' rights would have legitimacy. As it is, however, the central determinant of this “right” is how much the insurance policy costs and what is covered. To so diminish the meaning of “right” within the miasma of managed care is to lose sight of the real possibilities of applying a positive “right” to healthcare and, in the long run, is to diminish the ethics of healthcare.
